These brokers are either officially registered with the NFA (and subject to CFTC regulations) or are international firms that serve US traders in defiance of the Dodd-Frank Wall Street Reform and Consumer Protection Act, which prohibits such activities. In accordance with regulations governing the US spot Forex market, only duly registered brokers are permitted to solicit and provide services to US residents. These regulations also impose significant constraints on their trading conditions. To adhere to the regulatory framework of the American FX market, a broker must offer leverage no higher than 1:50 for major currency pairs (even lower for minor and exotic pairs) and endorse no-hedging accounts. A regulated broker is also obligated to maintain a minimum capital of $20 million and adhere to stringent monitoring, supervision, and risk management standards.
